YOUR RIGHTS AS A DEBTOR
You may be a debtor but the law still gives you plenty of clout.
If you owe money to anyone, whether to an individual or a corporation there are certain legal rights available to you Unfortunately many people who are in debt may not know of them, especially if being in debt is a new experience.
One of these rights, a very important one which is often overlooked even by people who are otherwise pretty clued-up, is the right to fair collection practices.
Debt collection agencies MUST follow these practices and, if they don't or if they think they can get away with it, then they will be guilty of harassment. If this happens you can turn the tables on them very effectively. And they must follow other guidelines.
These are --
They may only contact you between 8.00 a.m. and 9 p.m.
They cannot contact you at your place of employment if they know that your employer disapproves or without your previous consent.
They are not allowed to share your information, including the fact that they are trying to collect from you, with anyone.
They are not permitted to lie or trick you (such as falsely implying that you have committed an offense) into paying
They may not harass, oppress, or abuse you.
They must identify themselves if they call you on the phone.
And lastly, but most importantly, if you send them a written request to stop contacting you they must by law obey.
